24 HOUR LEADERSHIP CHALLENGE - TERMS & CONDITIONS / WAIVER

1. ACKNOWLEDGMENT OF RISK AND RESPONSIBILITY

By registering for and participating in the 24 Hour Leadership Challenge (the “Event”) conducted by High Performance Leaders (“HPL”), I acknowledge and agree that:

  • I am voluntarily participating in a physically and mentally demanding event that may include, but is not limited to, endurance activities, outdoor challenges, group tasks, navigation, and other physically or psychologically intensive exercises.
  • I am aware that participation carries inherent risks of injury, illness, fatigue, equipment failure, environmental exposure, and other unforeseen hazards, which may result in personal injury, property damage, or, in rare cases, death.
  • I am solely responsible for ensuring that I am medically and physically fit to participate. I have no conditions, illnesses, or impairments that could affect my safety or the safety of others.
  • I will immediately notify an HPL staff member or facilitator of any medical condition, injury, or concern that arises before or during the Event.
  • I willingly assume all risks, both known and unknown, associated with participation in this Event.

2. RELEASE OF LIABILITY

In consideration for being allowed to participate in the Event, I, for myself, my heirs, executors, administrators, successors, and assigns, hereby:

  • Release, discharge, and hold harmless High Performance Leaders, its directors, employees, contractors, facilitators, agents, sponsors, and volunteers (collectively “the Released Parties”) from any and all claims, demands, actions, or causes of action that may arise from my participation in the Event, including claims for personal injury, illness, death, or property damage, whether caused by negligence or otherwise.
  • Acknowledge that I am not relying on any representations or statements made by or on behalf of HPL other than those expressly stated in official Event materials.
  • Understand that by agreeing to these terms, I am waiving valuable legal rights that I might otherwise have against the Released Parties.

3. INDEMNIFICATION

I agree to indemnify and keep indemnified High Performance Leaders and all Released Parties against any and all loss, damage, cost, or expense (including legal costs) incurred as a result of:

  • Any injury, illness, death, or property damage I may cause to myself or others through my negligent or intentional acts or omissions during the Event; or
  • My failure to comply with Event rules, facilitator instructions, or any applicable laws and safety requirements.

4. MEDICAL CONSENT

In the event that I suffer an injury or illness during the Event, I consent to HPL and its representatives:

  • Administering first aid as deemed necessary; and
  • Arranging emergency medical treatment, evacuation, or transportation to a medical facility if required for my safety or wellbeing.
    I understand that I am responsible for any costs associated with such medical treatment or transport.

5. PHOTO, VIDEO & MEDIA RELEASE

I acknowledge and agree that:

  • Photographs, videos, and other media may be captured during the Event by HPL representatives or contractors.
  • HPL may use these images and recordings for promotional, marketing, and educational purposes, including but not limited to social media, websites, and print materials.
  • These materials will not be sold to third parties.
    If I do not wish my image to be used, I will notify HPL in writing prior to the commencement of the Event.

6. NON-REFUNDABLE REGISTRATION

I understand that the Event requires extensive planning and limited participant numbers.

  • Once my registration is confirmed, all fees are non-refundable, except where required by Australian Consumer Law.
  • This includes situations where I withdraw due to change of mind, scheduling conflicts, or personal circumstances (“cold feet”).
  • If I am unable to attend, I may request to transfer my place to another participant, subject to HPL approval.

7. PERSONAL CONDUCT AND PARTICIPATION

I agree to:

  • Follow all reasonable directions from HPL facilitators and staff throughout the Event.
  • Act responsibly and respectfully toward others at all times.
  • Accept that HPL reserves the right to remove any participant from the Event if their conduct is deemed unsafe, disruptive, or contrary to the intent of the challenge.
  • No refund will be provided in such cases.

8. PRIVACY

HPL may collect personal information such as contact details, emergency contacts, and medical information solely for the purpose of conducting the Event safely and effectively.

  • My information will not be shared with any third party except where necessary for safety, medical, or legal purposes.
  • HPL may use my email address to notify me of future events or related programs. I can opt out of promotional communications at any time.

9. GOVERNING LAW

This agreement shall be governed by and construed in accordance with the laws of Western Australia, and any disputes arising shall be subject to the exclusive jurisdiction of the courts of that state.

10. AGREEMENT

By selecting “I Agree” at the time of registration, I confirm that:

  • I have read and understood this Terms & Conditions / Waiver in full;
  • I am of legal age and competent to agree to these terms;
  • I acknowledge the inherent risks involved and accept full responsibility for my participation;
  • I am waiving certain legal rights and agree to indemnify the Released Parties as described above.
